Staff Counsel
Litigation, Risk, and
Clinical Affairs
This Staff Counsel position
will primarily provide legal advice related to litigation, risk and claims
management, and regulatory matters including clinical affairs and operations.
The staff counsel is responsible for providing high quality and strategic legal
advice to UCHealth’s internal clients. They will assist other members on the
legal team as assigned by Associate General Counsel and the Chief Legal
Officer.
Primary practice areas:
- Clinical Services and Patient Care
- Litigation and claims management (commercial
claims as well as professional and general liability)
- Medical Staff (Governance Documents,
Professional Review, Investigations, Credentials and Privileging, Scope of
Practice)
- Patient Rights (Informed Consent, Mental
Health, Grievances)
- Regulatory, Accreditation, and Licensure
- Risk Management, Patient Safety
- Subpoenas, Search Warrants, Requests for
Information
Responsibilities Include:
- Assisting attorneys in the legal
department on hospital, ambulatory surgery center, and other state and federal
regulatory compliance matters; medical staff matters; providing legal counsel
to the self-insurance program at UCHealth for professional and general
liability matters
- Identifying and analyzing legal issues,
drafting documents, and presenting clear recommendations
- Maintaining current knowledge regarding
existing and new and emerging laws and policy developments impacting UCHealth
and its affiliated facilities and medical group
- Researching
of state and federal legislation and administrative and court decisions;
investigate legal problems and make recommendation
- Advising on legal
review of corporate documents and communications
- Conducting state and
federal legal research as needed to analyze, synthesize, communicate and
memorializes institutional knowledge related to legal concepts for general
business use
- Participating in and
offering counsel related to policy creation, updates and approvals
- Preparing and reviewing
various agreements, memoranda, and other legal documents
- Collaborating with
other members of the legal department, risk management departments, and
stakeholders throughout the organization
- Providing other legal support as
directed or as circumstances may require to support management and protect
UCHealth’s legal interests
Job Qualifications
- Juris Doctorate
- 4+ years’ experience in relevant areas
- Preferred: Meaningful experience in two
or more of the following: health care
regulatory laws impacting patient care, including but not limited to informed
consent, decision making, patient rights; Section 1557 of the Affordable Care
Act and other laws related to public accommodation requirements; state facility
licensure; state law related to medical staff and peer review; Medicare
Conditions of Participation and Conditions for Coverage; EMTALA; HIPAA;
hospital revenue cycle functions; subpoenas; professional and general liability
claims; investigations
- Excellent academic credentials
- Colorado Bar admission or ability to
practice in Colorado
- Sound judgment
- Ability to work in a
busy and stressful environment
- Strong interpersonal,
verbal and written communication skills
- Strong creativity,
problem analysis and decision-making skills
- Exercises tact,
discretion, sensitivity and maintains confidentiality
- Detail oriented,
highly-organized and the ability to prioritize
- Standard office
equipment and computer applications; MS Office, internet applications etc.
- Strong interpersonal
skills and ability to take on multiple responsibilities while prioritizing
competing projects
The midpoint pay for this position is: $82.31 / hour. Midpoint is based on approximately 10-15 years of relevant work experience.
